§ 1 Preamble

( 1 ) The following General terms and conditions of business are applicable to all contracts, deliveries and other services in the version valid at the date of order. The contracts with the client are concluded on the basis of these general terms and conditions of business, whose content the client had taken note of and which he explicitly agrees with.

( 2 ) Dissenting terms and conditions of the contracting partner are not approved, except in the case of a written approval.

( 3 ) Beautyworld reserves the right to change or amend these general terms and conditions of business. Orders received prior to the change are handled according to the general terms and conditions of business, which had been valid at the date of the order.

§ 2 Conclusion of the purchase contract

( 1 ) The sale of goods takes place only to a volume usual for private use. Orders with a bigger volume require a special request to Beautyworld. The presentation of the goods at the web pages of Beautyworld is an invitatio ad offerendum, not an offer.

( 2 ) The purchase contract between the client and Beautyworld is concluded in the following way: The client makes with his order by e-mail, fax or other form an offer to Beautyworld for the purchase of the goods. The receipt of the order is immediately confirmed by e-mail. This is not the acceptance of the offer to conclude a purchase contract by the client. Beautyworld reserves the right to accept the offer of the client within two weeks through confirmation by e-mail or through delivery of the goods with the terms valid at the date of the order. If the offer is not accepted within two weeks it is no longer binding for the client.

( 3 ) Beautyworld will immediately inform the client about mistakes in the description of goods and will make a counteroffer, if necessary. Minor variations and technical changes compared to the pictures and descriptions are possible.

( 4 ) The order can only take place successfully if the client has given his approval to these general terms and conditions of business and has taken note of the information concerning the revocation.

§ 3 Delivery

( 1 ) The shipping of the goods takes place as fast as possible. The shipping of the goods which are subject of this contract and of other products takes place worldwide. The mailing expenses depend upon the purchase price. We reserve the right to perform a partial delivery, if this seems to be reasonable for a quick execution. If not agreed otherwise the delivery takes place from the stock of Beautyworld to the delivery address given by the orderer.

( 2 ) Shipping costs

The prices at the product sites include the value added tax and other price components. In addition to the indicated prices we bring into account shipping costs for the delivery, which are depending from the purchase price. The delivery costs are explained to you at the shopping cart system and at the order site.

§ 4 Due date, payment and default

Beautyworld only accepts the payment methods indicated to the client during the order procedure. All prices include the value added tax of 19 % at the moment. The payment terms for bills not within the internet are 14 days, except that other payment practices are agreed in written form. If the client falls into default with payment, Beautyworld is entitled to claim default interest to an amount of 5 % over the base rate of the European central bank. Beautyworld reserves the right to claim a higher damage caused by delay, if such a damage arises and is detectable.

§5 Revocation
Withdrawal

You can cancel your contract within 14 days without giving reasons in writing (eg letter, fax, e-mail) or - if the goods before the deadline - by returning the goods. The time limit begins after receipt of this notification in writing, but not before receipt of the goods by the consignee (in case of recurring deliveries of similar goods not before receipt of the first partial delivery) and also does not fulfill our obligations under Article 246 § 2 in connection with § 1 Paragraphs 1 and 2 EGBGB and our obligations according to § 312e paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. Consequences
In the case of an effective cancellation the mutually received benefits and any benefits (eg interest). Can you give us the received achievement totally or partly or only in deteriorated condition, you must pay us compensation for the value. With the release of things this does not apply if the deterioration of the case solely on the test - as it would have been possible in a store - is due. In addition, you can avoid the obligation to pay compensation for a purpose by putting the article as provided by the goods as your property and everything that could reduce its value. Package are to be returned at our risk. You have to bear the cost of return if the delivered goods ordered and if the price returned the case of an amount of not exceeding 40 euros or if you are at a higher price the thing at the time of the revocation yet the return or a contractually have agreed partial payment provided. Otherwise, the return is free for you. Not parcel things do you pick. Obligations to reimburse payments must be made within 30 days. The period begins with the sending of your cancellation or the goods, for us, with their reception.

§ 6 Warranty

( 1 ) If the delivered good which is subject to the purchase contract shows a defect, the good will be replaced exempt from charges or the purchase price will be repaid.

( 2 ) Beautyworld can refuse to perform the kind of supplementary performance chosen by the client if it is only possible with disproportional costs. The value of the good free of defects, the importance of the defect and the question, if another kind of supplementary performance is possible without major drawbacks for the client, must be considered. The rights of the client in this case are limited to the other kind of supplementary performance, the right of the seller to refuse this other supplementary performance according to the law is untouched by this. The warranty of the seller takes place according to the law.

§ 7 Withdrawal from the contract

( 1 ) We try to deliver the goods as fast as possible or at the date of delivery desired by you. If the failure to keep a delivery time is caused by force majeure, strike, unpredictable circumstances or other circumstances which are not within our control, the delivery time is extended in an adequate way. Under circumstances not mentioned above the buyer is entitled to give a respite in written form and to withdraw from the contract if the respite is terminated fruitless. If the impossibility is the consequence of a disability by the manufacturer or supplier, both we and the client may withdraw from the contract if the delivery term is exceeded for more than a month. In this case the client is immediately informed about the unavailability and the consideration is returned immediately.

§ 8 Claims for indemnity

Claims for indemnity by the client are excluded, except for the case that Beautyworld or a representative or vicarious agent of Beautyworld acted intentionally or with gross negligence. This disclaimer is not applicable to damages of life, body or health.

§ 9 Retention of title

The delivered goods remain property of Beautyworld till the full payment.

§ 10 Data protection

Raising, converting and usage of your data

You may visit our site without giving data concerning your person. We save only data which is not individual-related such as f. e. the name of your internet service provider, the site from which you are visiting us or the name of the requested data file. These data are evaluated only for the perfection of our services and do not allow a conclusion to your person.

Individual- related data are raised only if you transfer it to us voluntarily during the order procedure, the opening of a client account or at the registration for our newsletter. We use your data without your approval only for the fulfilment and clearing of your order. With the execution of the order and the full payment of the purchase price your data are barred for further use and will be deleted as fast as allowed by the tax and commercial law provisions, if you have not given the approval for a further use of your data. With the registration for our newsletter your e-mail address is used for our own advertising purposes, until you check out.

Transfer of individual- related data

A transfer of your data takes place to the delivery firm, if this is necessary for the delivery. For the execution of payments we transfer your payment data to the bank in charge of payments. A transfer to others does not take place.

Data safety

Your individual-related data is encrypted by SSL v3, RC4, RSA with exchange of 1024 Bit, given by Thawte Server Certification Authority, transferred through the internet. We secure our website and other systems by technical and organisational measures against loss, destruction, access, modification and distribution of your data by unauthorised persons. The access to your client account is only possible with your personal password. You should treat your access data as confidential and close the browser window after having finished the communication with us, especially if you use the computer together with other persons.

Right of access

According to the Bundesdatenschutzgesetz ( Federal Data Protection Act ) you have the right of gratuitous access to your saved data and the right of adjustment, barring or erasure of these data.

Revocation of consent

The following consents were given by you during the order procedure. We inform you that you may revoke these consents at any time with effect for the future.

I want to receive interesting offers at regular intervals by e-mail. My e-mail address is not transferred to other companies. This consent to use my e-mail-address for advertising purposes can be revoked by an informal notice f. e. by e-mail to beautyworld-glienicke@gmx.de at any time with effect for the future.

§ 11 Jurisdiction agreement

If the contracting parties are merchants, public bodies or special assets, the jurisdiction for all legal questions connected to this contract is at the seat of Beautyworld, D-16548 Glienicke.
